"What I'll Do For Music" - Terms and Conditions
1. This is a social network application scheme ("the Application") which provides the opportunity to allow anyone who subscribe to DiGi Music Unlimited Music services ("Music Services") to enjoy certain redemption benefits ("the Referrer") by referring another person to subscribe to the Music Services ("the  Referee") in exchange for certain favors to be provided by the Referrer ("the Favors"). 2. Once the Referee clicks on the ‘accept' button, the Referee shall be directed to subscribe to DiGi Music Unlimited Music Services. The Referrer shall only be entitled to the redemption benefits ("the Benefits") upon the successful subscription of the Referee to the Music Services. 3. By participating in "What I'll Do For Music", both the Referrer and the Referee is deemed to have agreed to these terms and conditions. 4. In any event, DiGi does not guarantee or warrant in any way and is not responsible in any way whatsoever for the fulfillment or non-fulfillment of the Favors stipulated herein to be provided by the Referrer. 5. The Benefits 5.1 The Benefits shall vary as described in the Application. 5.2 The Benefits are not transferable, nor exchangeable for cash, credit or kind. 5.3 Any pictures or images of the Benefits are solely for the purpose of illustration only. Terms and conditions governing the Benefits shall apply. 5.4 DiGi reserves the sole and absolute right to choose the colour and/or the model of the Benefits and/or substitute the Benefits with an item of equal value without giving prior notice to the Referrer. 5.5 Each Referrer is only entitled to only one set of Benefit subject to the number of referrals. Only the redemption of the first Benefit during the respective redemption window is allowed. 5.6 Registration of the same MSISDN on multiple Application profiles residing on the same or different online social networks is not allowed. Any one MSISDN can only be registered to one social network profile. 5.7 At the time the Referrer or any person is entitled to the Benefits (as per item 2 above) and at the time of collection of the Benefits, the Referrer's MSISDN must be active and the Referrer must be an active subscriber to the Music Services. 5.8 To the fullest extent permitted by law, DiGi and the sponsors hereby expressly excludes and disclaims any representations, warranties, or endorsements, express or implied, written or oral, including but not limited to, any warranty of quality, merchantability or fitness for a particular purpose in respect of the Benefits. 5.9 The Benefits will encapsulate events tickets and other items as specified by DiGi. The maximum number of items available for redemption are as follows:   Number of referrals Maximum Number of redemptions 1 Referee 100 2 Referees 50 3 Referees or more 30 5.10 The top 30 Referrers with the most referees will also be entitled to an additional meet-and-greet pass as determined by DiGi. 5.11 Where there are multiple artist and locations, the meet-and-greet passes will be divided equally in the following manner:   Artist / location Number of meet-and-greet passes Evan Yo/Kuala Lumpur 5 Evan Yo/Penang 5 Evan Yo/Kota Kinabalu 5 Y2J/Kuala Lumpur 5 Y2J/Penang 5 Y2J/Kota Kinabalu 5   The top 30 Referrers will be contacted to ask for their choice of artist and location. Limited meet-and-greet passes are available. Hence, the meet-and-greet passes will be given to the Referrers who are the earliest to qualify whilst there are still meet-and-greet passes available. 6. Eligibility 6.1 All DiGi postpaid and prepaid subscribers are eligible to become a Referrer and Referee except permanent, contract and temporary employees of DiGi Telecommunications Sdn Bhd (201283-M) ("DiGi"). 6.2 The Benefits are given away based on first come first serve basis and while stocks lasts. 6.3 DiGi reserves the right to reject any entries at its sole and absolute discretion without having to assign any reasons whatsoever. 6.4 Terms and conditions governing the Music Services shall apply to the Referee. 6.5 In the event a Referrer or a Referee is found to be ineligible at any point of time, DiGi reserves the right to disqualify the said Referrer or a Referee and to cancel/ withdraw/ recall the Benefits. If the Benefits have been delivered to the ineligible Referrer, the ineligible Referrer hereby agree and undertake to return the Benefits to DiGi without any claim whatsoever, failing which, DiGi shall have the right to initiate any action it deems necessary against the ineligible Referrer. 6.6 In the event the Referrer does not collect the Benefits at the times and place specified by DiGi, that Referrer will automatically be disqualified and DiGi reserves the right to keep the Benefits to be used for another promotional activity. 6.7 The Referrer and the Referee that are disqualified pursuant to this clause hereby agree that they shall not make any claim and/or demand whatsoever to DiGi for the Benefits. 7. Giveaway Mechanics 7.1 On certain dates as announced by DiGi ("Promotion Period"), DiGi shall specify certain Benefits which are subject to the terms and conditions herein. 7.2 The Referrer who are successful with their online redemptions will be sent an SMS and an email to inform them of the date, time, and place for collections of the Benefits. The Referrer must be personally present to collect the Benefits. 7.3 Normal SMS and GPRS charges apply to all DiGi services accessed through the SMS or WAP/GPRS/EDGE channels respectively. 8. Restrictions in the Meet & Greet a. The M&G is only limited to the group photo with individual artist, with maximum 10 winners only. b. Other request such as individual photo with artist, autograph etc, are not allowed. c. All participants (including winner, media, bloggers) are not allowed to bring their own camera. Only official photography is allowed, the winner can download the photo via digimusic.com.my/live on 20 December 2009 onwards. d. All winners must be gather at specific location and time, which will mention by DiGi during the notification of winners. The late-comers are not allowed to attend the meet & greet session. 9. The Referrer needs to be 12 years old and above. By participating, the Referrer below the age of 18 confirm that they have obtained prior consent from their respective parents/guardian. In the event the Referrer has not obtained the said parental/ guardian consent, DiGi reserves the right to cancel the participation and to forfeit the Benefits. 10. DiGi does not warrant that the Application, the Music Services or/and the Benefits shall be uninterruptible and/or error free. 11. DiGi reserves the sole and absolute right to alter or terminate the Application, the Benefits, the Promotion Period or any part thereof without giving any prior notice and no compensation in cash or in kind shall be given to the Referrer and/or the Referee. 12. DiGi reserves the right to cancel, terminate or suspend the Application, the Benefits, the Promotion Period or any part thereof with or without any prior notice. For the avoidance of doubt, cancellation, termination or suspension by DiGi of the Application, the Benefits, the Promotion Period or any part thereof shall not entitled the Referrer and/or the Referee to any claim or compensation against DiGi for any and all loss or damage suffered or incurred by the Referrers and/or the Referee as a direct or indirect result of the act of cancellation, termination or suspension. 13. DiGi reserves the right at its absolute discretion to vary, delete or add to any of these Terms and Conditions from time to time without prior notice. 14. DiGi shall not be responsible or liable for any claims of loss or damage to property or any personal injury or loss of life resulting from or in connection with the Application, the Benefits, the Promotion Period or any part thereof. 15. DiGi shall not be responsible or liable to the Referrer and/or the Referee in the event the Application, the Benefits, the Promotion Period or any part thereof is postponed and/ or cancelled. By participating, the Referrers hereby acknowledge and irrevocably agree that DiGi shall not in any manner be liable for any interruption and/or error resulting from or in connection with the Application, the Benefits, the Promotion Period or any part thereof. 16. The Referrer and/or the Referee hereby irrevocably agree and give consent to DiGi to use the information or publish any related matter to the entries including and not limited to the Referrer and or the Referee's names, and photographs for current and future advertising and promotional purposes. 17. DiGi reserves the right to withhold the Benefits aforementioned at DiGi's sole and absolute discretion should there be any fraud cases detected before the Benefits are given to the Referrers. 18. DiGi reserves the right to change the mechanics, the Application, the Benefits or the Promotion Period at DiGi's sole discretion should the situation demand so. 19. DiGi shall not be liable for any loss or damage (including without limitation loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with the Application, the Benefits, the Promotion Period or any part thereof, even if DiGi has been advised of the possibility of such damages in advance, and all such damages are expressly excluded. 20. All Referrers and Referee agree to be bound by the official rules and regulations and decisions of DiGi. 21. A failure by DiGi to enforce any of these Terms and Conditions in any instance(s) will not give rise to any claim by any person. 22. All other terms and conditions governing the use of any of DiGi's mobile telecommunication services in relation to the Application, the Benefits, the Promotion Period or any part thereof shall apply herein mutatis mutandis. 23. These terms and conditions shall be governed and construed by the Laws of Malaysia and the parties shall submit to the exclusive jurisdiction of the Courts of Malaya.
